A tenant who wants to stay, and a landlord who will not renew or who is pushing terms the tenant disputes, is a claim the RDC hears — renewal is one of the request types registered as a first-instance case.
What Decides a Renewal Claim
The paper trail between the two sides. What was notified and when, what rent was demanded, whether the tenant made an offer, and where the tenant stands on rent already due. A renewal claim brought without that record behind it is a claim with nothing to rest on.
What We Study Before Advising a Course
- The current contract and its Ejari registration
- The correspondence between landlord and tenant
- Notices about a rent increase or a change to the contract terms
- The rental value being demanded
- Any earlier notices served between the parties
- Any offer the tenant has already made, and the tenant’s position on rent due
If the Landlord Will Not Take the Rent, Deposit It First
Where the landlord is refusing the rent or the cheques as well as the renewal, the offer and deposit request is the step that records the tenant’s position formally. Its receipt is also among the documents the RDC asks for later when an execution file is opened on a renewal judgment.
If the Renewal Is Awarded
A renewal judgment is enforceable. The RDC lists the execution of a tenancy renewal among the request types an execution file covers, so a landlord who ignores the judgment is met with an execution file rather than another round of correspondence.
Filing Without an Emirates ID
A tenant holding only a passport cannot register the renewal claim in their own name — the RDC requires the Emirates ID as the applicant’s identity document. The claim is filed through a notarized POA to someone who holds an Emirates ID, registered on the file at the RDC, which also covers the offer and deposit step where the landlord is refusing the rent.
Frequently Asked Questions
Renewal is one of the request types the RDC registers as a first-instance claim, so it can be asked for. Whether the claim succeeds turns on the documents — the contract, the notices, the rental value demanded and the tenant’s position on rent due — which is why the file is studied before a course is chosen.
The tenant’s position on rent due is one of the things studied before the claim is prepared, precisely because it carries weight in the file. Where the landlord is the one refusing to take the money, the offer and deposit request is the route that records the tenant is ready to pay.
An execution file is opened on it. The RDC lists the execution of a tenancy renewal among the request types an execution file covers, and the offer-and-deposit receipt is among the documents asked for at that stage — which is the reason to keep it from the moment the deposit is made.
