Once the execution file is open and the executive writ notice has been served on the party against whom execution is sought, the file does not advance on its own. It advances through requests put to the execution judge — and those requests open seven days after that service.

Which Requests Can Be Submitted

It depends on what the file shows and on what the execution judge decides. The RDC confirms that a travel-ban request and an arrest-and-bring request in execution files are made through the e-requests section and are put before the execution judge for a decision, and the same section carries precautionary seizure, a payment-grace request, and waiver or settlement requests.

Requests We Prepare and Follow

  • Enquiry into the funds and balances of the party against whom execution is sought
  • Seizure requests, including precautionary seizure
  • A travel-ban request, and an arrest-and-bring request, where their conditions are met
  • Expediting the steps, or following the execution of an earlier order
  • Bringing forward or adjusting the eviction date where there is a reason
  • Cancelling or adjusting an instalment plan where it has been breached
  • Settlement requests, or proving payment

How a Request Reaches the Judge

The RDC describes the same route for each of them: log in, search for the execution file, open the e-requests tab, submit the request and pay the fee due on it. The request is then put before the execution judge. What changes between one request and another is not the mechanism but what the request has to establish — and that is where a file succeeds or stalls.

Each Request Is a Decision, Not a Formality

Every request is put before the execution judge, who decides on it. Which request suits the file is read from what the file actually shows about the other side — funds, assets, or steps available against them — not from a standard list applied to every case.

Filing Without an Emirates ID

E-requests are submitted from inside the execution file, so whoever holds the file has to be able to reach it. The RDC works from the Emirates ID for individuals; where only a passport is held, a notarized POA to someone who holds an Emirates ID carries both the file and the requests made on it. A POA drafted only for opening the file stops short of this stage.
